PROTECTION OF PERSONAL INFORMATION AND PRIVACY POLICY

  1. INTRODUCTION AND PURPOSE OF THIS POLICY
    1. We take seriously the protection of your privacy and information (as defined in the Protection of Personal Information Act, 4 of 2013 (hereinafter referred to as “the POPI Act”). 
    2. The purpose of this privacy policy (hereinafter referred to as “the Policy”) is to explain how and why we collect, process, store, disclose and retain your personal information in accordance with the POPI Act. 
    3. The Policy as well as our Terms and Conditions must be read before you agree to utilise our services including through our website / mobile app. By utilising our services, including through registering an online profile with us, you agree that you have read and agreed to both the Policy and Terms and Conditions and they form part of our agreement with you as either a natural or juristic person.
  1. SAFEGUARDING PERSONAL INFORMATION
    1. Personal information is as defined in the POPI Act and includes any information by which you can be identified and which relates to you as an individual, including your full name, identity number, date of birth, address(es), electronic mail address(es), contact number(s), personal usernames, passwords, profile pictures and age.
    2. In order for you to utilise our services, it is necessary for us to collect, collate, process, store and / or retain your personal information.  
    3. By utilising our services, you agree that we may collect, collate, process, store and / or retain personal information that you may be required and / or elect to provide to us through:
      1. your access and use of our website and / or mobile app;
      2. in correspondence with any of our employees or representatives, 
      3. your use of our services, products and / or goods;
      4. you registering an online profile with us including through inputting any information in an application form to register an online profile;
      5. you applying to us for a job;
      6. you supplying services to us and / or contracting with us.
    4. Though we cannot mitigate against all potential security threats, we take reasonable steps to protect all your personal information we may hold and minimise any threats to your privacy.
    5. In the event that there is a data breach that directly affects the security of your personal information, we will follow the guidelines and requirements of the relevant legislation to notify you and any other necessary authorities required by law.
    6. You play an integral role in the protection of your personal information and privacy by never sharing your username or password that provides access to an online profile you may have with us. In this regard, you are strongly encouraged to ensure your password is sufficiently unique and change it regularly.
  1. COLLECTION AND PROCESSING OF PERSONAL INFORMATION
    1. In order to utilise our services and products, you are required to supply certain personal information with us. This is information that you voluntarily provide. To the extent that you refuse to provide this information, you will not be able to utilise our services.  This information will be collected and stored by us, including:
      1. personal information including your name, identity number, delivery / physical address, contact number and email address;
      2. financial information including your credit and / or debit card number(s), expiry date, security code and billing information;
      3. user information including your username and password;
      4. geo-location information including your IP address and physical location(s).
    2. Over and above this necessary personal information, in utilising our services and interacting with our website and / or app, you may elect to provide us with further personal information, and further information you may provide to us via electronic mail or telephonic conversation. This information will also be collected and stored by us. We may also collect personal information from other sources and third parties in the provision of our services to you.
    3. You acknowledging consent that all personal information collected and processed by us may be stored by us and used for purposes specified in the Policy, namely in order for you to utilise our services provided through our website and / or mobile app.
    4. We use your personal information in order for us to provide you with our products and services, including:
      1. the processing of your financial information to facilitate and complete transactions;
      2. processing orders and transactions, delivering products that you may order;
      3. conducting market research to understand your preferences and curate personalised suggestions and improve our service provision to you;
      4. engaging with you directly;
      5. when we have a legal duty to use or disclose your personal information.
  1. RETENTION OF PERSONAL INFORMATION
    1. We may retain and store your personal information manually and / or electronically. 
    2. When you provide us with your personal information, you consent to us processing, storing and retaining it for the specific purposes it was provided, with the overall understanding that it is provided in order for us to fulfil our services and / or products offering. 
    3. Accordingly, your personal information will be kept for as long as is necessary in order for us to fulfil this purpose, including as long as you remain a registered user on our website / app. We may keep your personal information for longer than this should we be required to do so by law or there is another lawful purpose to retain your personal information.
    4. In this regard, your personal information is stored on the Savour server, hosted by Xneelo which is located in South Africa.
  1. SHARING OF PERSONAL INFORMATION
    1. Given the nature of the services and products we provide, we may share your information with third-party service providers, including the entities who own or are in control of third-party service providers. By utilising our services, you consent to the necessary processing and sharing of your information with our third-party service providers.
    2. We may also disclose your personal information to third parties to the extent that we are required to by law and / or to protect the rights and safety of us, our employees and / or our users. 
    3. Some of our third-party service providers operate outside of South Africa and accordingly, personal information that we may collect from you may be retained, stored or transferred to a location outside of the Republic of South Africa. By voluntarily providing us with your personal information through utilising our services / products, you agree to this transfer, storing, retaining and processing. 
  1. YOUR RIGHTS
    1. You are entitled to:
      1. request that we correct, destroy or delete any of your personal information that we hold, bearing in mind that the deletion of certain information may necessarily result in us being unable to continue to provide our services and products to you.  The personal information that you may request us to correct, destroy or delete is subject to certain conditions and may include that which is inaccurate, irrelevant, excessive, out of date or incomplete;
      2. view and correct some of your information in your registered online profile. You have the right to request access to and / or request the correction of any other personal information that we may hold. Any requests of this nature may be sent to our Information Officer described in paragraph 9 below.
      3. object to us processing your personal information, bearing in mind that in doing so may necessarily result in us being unable to continue to provide our services and products to you;
      4. unsubscribe from direct marketing communications we may send you;
      5. submit a complaint to the appropriate regulatory authorities, including the Information Regulator;
      6. advise us if you believe someone is unlawfully using your account.
    2. We may require acceptable proof of identity before we take any steps in regards to any of the above requests.

    1. We do not knowingly collect or process the personal information of people under 18 years of age in the absence of express consent from their parents or guardians.
